“Never seen before while MÜVing” Contest rules

1. How to enter

The “Never seen before while MÜVing” Contest (the “Contest”) will begin on Monday, June 15, 2009 at 12:01 a.m. EST and will end on Monday, September 7, 2009 at 12:01 a.m. EST in Montréal on the Müvmédia Web site (the “Site”), managed by Espresso communication et design (“Espresso”). 

To enter the Contest for a chance of winning our prize, entrants must have reached the age of majority in their province of residence and comply with other eligibility requirements hereby mentioned.

1.1.1 Here’s how entrants can win the prize: 

A chance to win the “Never seen before while MÜVing” contest when submitting a multimedia report, which content has been produced while traveling and that respects the contest’s theme. The participants will be able to apply between June 15th and July 31rst 2009. The multimedia reports that satisfy requirements of the editorial comity will be put online on our Web site www.muvmedia.com and will then follow the voting period starting from August 1rst to September 7th, 2009.

The editorial comity is composed of the Site’s administrators, Olivier Coullerez, president and founder, Marie-Ève Berlinger, delegated producer and Marie-Michèle Voyer, logistic coordinator.

The requirements need to be respected in order that the multimedia document to be online on the Site. Only the editorial comity will take decision concerning this subject. These are the basic standards required established for the Contest:

Complete entry Entrants must submit a multimedia document, either a video (no more than two minutes long), a photo, or an audio track, produced while travelling, along with a brief description (maximum of 300 words) of the journey in question.

Respect of the theme “Never seen before while MÜVing” means uncommon, in other words, an anecdote or experience from your trip that really stood out. It also means NOT submitting content that can be considered mass tourism or that resembles a post card.

Quality of the multimedia document In order to maintain a certain quality of the Site’s content, the Editorial Committee reserves the right to refuse a multimedia document submitted if the quality of the latter is deemed mediocre (video with a flickering or hazy picture, a pixelated or poorly centred picture, audio track that is hard to hear…).

Content The content of the Site respects the values of the producer Espresso productions in terms of respecting other human beings, religions, and cultures. The Editorial Committee reserves the right to refuse any entry if the content is indecent, shocking, disrespectful, or simply does not reflect the values endorsed by Espresso.

2. Draw (Designation of winners) 

2.1 Among the reports that have been selected and put online for the contest between July 31rst to September 7th, 2009, the three documents most viewed by the public will be identified at Espresso’s offices on Monday, September 7, 2009 at 1:00 p.m. at 3863 Saint-Laurent Boulevard, suite 207, Montréal, Quebec  H2W 1Y1. Our technicians will check to see if there was any cheating so as to determine the legitimate Winner. The Winner’s name will appear on the Site as of September 18, 2009 for an indeterminate period.

3. Prize

3.1 Prize awarded to the Winner 

3.1.1 The entrant who will be declared the Winner will be offered the following prize, with a total value of C$850, hereinafter referred to as the “Prize.”

A Canon HV-30 camera and a used Sherpa 200R tripod (Purchased for the Müvmedia Rally 2007. Value at time of purchase: C$109.99)

3.3 All that is not expressly mentioned as included in the Prize is excluded and is at the Winner’s expense, including long-lasting batteries, videocassettes, microphones (shotgun mic, tie mic…).

3.4 Espresso reserves the right at its absolute discretion to replace the prize with another prize of equal value. 

4. General rules

4.1 Espresso will contact the Winner by e-mail the week of September 14, 2009. The Winner must confirm his or her complete mailing address and reply to the e-mail within 10 days following receipt. By replying to the e-mail, the Winner accepts the terms and conditions of these Contest Rules, as well as the Declaration and Release form attached to the e-mail and will have no recourse towards Espresso. Details about the Prize and how to take possession of the Prize will be sent to the Winner by e-mail. The Prize must be collected at Espresso within a maximum of one year following its awarding. The Prize will be forfeited if the Winner has not properly replied to his or her e-mail within ten (10) days following its receipt and, where relevant, the Prize will not be subject of another draw and will simply not be awarded. 

4.2 As of September 18, 2009, the name of the Contest Winner will be available on the Site. 

4.3 By entering this Contest, the Winner authorizes the organizers and their representatives to use, if necessary, his or her name, photograph, multimedia document submitted as part of this Contest, image, and/or voice for the purpose of announcing, through the media, that he or she is the Winner of the Contest Prize, without any form of remuneration.

4.4 Prize must be accepted as described in these Rules and may not, at the Winner’s request, be substituted for another prize or exchanged in whole or in part for money and/or transferred to another individual. 

4.5 This Contest is organized by Espresso. Subject to the conditions herein stipulated, the Contest is open to all residents of Canada, except for employees, agents and/or representatives of Espresso, their subsidiaries, affiliates, advertising agencies, or any individual directly involved with the Contest, as well as any individual with whom such employee, agent and/or representative resides or any member of their immediate family. For Contest Rules purposes, “immediate family” means father, mother, brother, sister, child, legal or de-facto spouse of such employee, agent and/or representative. All entrants randomly selected as part of this Contest who do not comply with these eligibility conditions will be automatically disqualified and a random draw will be held to select a new winner. Any entrant who is unable to comply with these eligibility conditions must inform Espresso as soon as he or she is contacted.

4.6 Espresso, its respective subsidiaries and any corporate entity of its corporate group, advertising or promotional agencies and respectively its stakeholders, administrators, executives, employees and any other individual connected to this Contest (hereby referred to as “Discharge Beneficiaries”) assume no responsibility related to the Prize and the Contest and will not provide any guaranties pertaining to it. 

4.7 Espresso and all other Discharge Beneficiaries will not be responsible for any incomplete or unclear coordinates from the participants. Espresso reserves the right to reject any Entry Request (multimedia document, text and information related to registration) containing a human or mechanical error. Espresso reserves the right to modify or cancel the Contest, without prior notice, if all necessary approvals are obtained from the Régie des alcools, des courses et des jeux du Québec.

4.8 The Contest organizers assume no responsibility regarding the loss, delay and destruction of e?mails, an error in the address on any e-mail, or computer malfunctions. All correspondence will be limited to a selection of eligible entrants. 

4.9 An entrant cannot win two prizes within a period of 30 days for any Contests held on the Site. Any entrant selected in this Contest and that is unable to comply with the eligibility conditions will automatically be disqualified and another draw will be held to determine a new winner. 

4.10 Notwithstanding paragraph 4.12, an entrant cannot win more than once during the same publicity contest. 

4.11 Contest rules are available at the Espresso office at 3863 Saint-Laurent Blvd., Suite 207, Montréal, Quebec  H2W 1Y1 from 8:30 a.m. to 4:30 p.m. and on the Site.

4.12 Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation regarding the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 

4.13 Contest judges’ decisions are final and without appeal. 

4.14 This Contest is subject to all applicable federal, provincial and municipal laws and regulations.
